You don’t need to rent a house to open a store, nor do you need formal business qualifications. You can just take photos and upload photos of the products to promote them, and you can make money by selling them. Due to the low operating costs and low risks of WeChat, more and more people use Moments for marketing as a way to make money. Jiang Fang, a female college student, sold cigarettes worth more than 100,000 yuan in her circle of friends as part of her work-study program. Recently, the Huangdao District Procuratorate of Qingdao City, Shandong Province prosecuted Jiang Fang on suspicion of illegal business operations.

Jiang Fang is a college student in a university in Qingdao. Due to her family's financial difficulties, she has always wanted to find a way to make money online to relieve her family's financial pressure.

In 2014, while browsing the web, Jiang Fang saw someone talking about making money by purchasing cigarettes on behalf of others, so she joined a QQ group specializing in reselling cigarettes from a website called "Waiyanba", and interacted with Xia in the group. Xia Fei got in touch and became Xia Fei’s sub-agent without obtaining a tobacco monopoly retail license. She first copied the cigarette photos from other friends in the group, saved them in her QQ space and WeChat Moments, and developed the surrounding friends and classmates into her own sub-agents, purchasing cigarettes from Xia Fei and others. Earn the price difference by reselling to your own sub-agents or friends in your circle of friends at a higher price. All transactions are settled through Alipay, and the transaction amount reaches more than 100,000 yuan.

As everyone knows, selling cigarettes privately through WeChat Moments without permission from the tobacco monopoly administrative department has violated national tobacco monopoly management laws and regulations. Jiang Fang and others sold cigarettes online without a license for a huge amount. They were arrested by the public security organs on suspicion of committing a crime. After the case, Jiang Fang confessed to selling cigarettes through WeChat Moments.

The prosecutor said: College students use entrepreneurship to relieve the financial pressure on their families. There is nothing wrong with selling goods through Moments, but not all goods can be sold at will. Chinese law stipulates that tobacco, salt and other specialty and monopoly items must obtain a special license before they can be circulated and traded. If a license is not obtained and sold through an online platform, if the amount reaches a certain amount, it may be suspected of illegal business crimes.
